This Beta Testing Agreement (BTA) is the commitment of Pho Tue SoftWare And Technology Solutions Joint Stock Company (Công ty Cổ Phần Giải Pháp Công Nghệ và Phần Mềm Phổ Tuệ) — (“Pho Tue SoftWare Solution JSC”) or (“HiTechCloud, Hi-Tech Cloud”) — to the Customer, being the party using the services of HiTechCloud by Pho Tue SoftWare Solution JSC, with respect to beta/trial features, in order to safeguard the interests of all Customers.

This BTA applies to the beta features of the services of HiTechCloud by Pho Tue SoftWare Solution JSC.

This SLA applies to trial — “beta” — features of services provided by HiTechCloud by Pho Tue SoftWare Solution JSC.

1. DEFINITIONS AND CONCEPTS

    Experimental features: new features added to the existing features of a service; these features are in development and/or being finalized; and they have not been officially released by HiTechCloud by Pho Tue SoftWare Solution JSC.

    Official features: the features supplied together with the Terms of Service (in the form of a service contract, a service usage contract, a service provision contract or any similar form) and whose quality is guaranteed in accordance with the commitment documentationservice quality (“SLA”).

    2. TERMS OF USE

    Experimental features are made available so that Customers can try new functionality during beta testing, on an opt-in basis. They are not provided by default in the services of HiTechCloud by Pho Tue SoftWare Solution JSC. Customers enable experimental features from the service settings.

    HiTechCloud by Pho Tue SoftWare Solution JSC ensures that beta features do not affect (damage and/or cause the loss of) data belonging to features that are already generally available in other services.

    By accepting these terms for beta functionality, the Customer understands and accepts that beta features may not work as intended and that data associated with them may be corrupted and/or lost. HiTechCloud by Pho Tue SoftWare Solution JSC accepts no responsibility for any harm (to people and/or property) suffered by the Customer or by any party connected to the Customer as a result of using beta functionality

    3. RESPONSIBILITIES OF HITECHCLOUD by PHO TUE SOFTWARE SOLUTIONS JSC

    Make every effort to deliver trial features to the Customer at the highest possible quality.

    Methods are in place to notify the Customer promptly when an incident occurs with the trial features.

    Guide the Customer on using trial features.

    4. CUSTOMER RESPONSIBILITIES

    Use trial features with due caution; do not store important data while using trial features.

    Do not use trial features for applications or activities that could cause harm (to people and/or property) to the Customer and/or to parties connected with the Customer.

    5. LIABILITY NOT EXCLUDED

    Agreeing to use the beta features under this agreement does not exclude the Customer's acceptance of the Terms of Service of HiTechCloud by Pho Tue SoftWare Solution JSC as set outhereand the VNG Cloud privacy policy set outhere. HiTechCloud by Pho Tue SoftWare Solution JSC reserves the right to apply the above rules throughout the Customer's use of the trial features.
