On IP address and ASN management, Decree 147 sets out the registration, use, allocation, and reclamation of internet addresses and autonomous system numbers (Article 17 of Decree 147), specifically:
1. Registration, allocation and assignment of IP addresses and ASNs:
Decree 147 sets out in detail the merging of two administrative procedures into one: "Allocation of internet addresses (or internet addresses and autonomous system numbers)." The requirements, procedures, and forms will be published and updated on the National Public Service Portal and on the VNNIC website athttps://vnnic.vn/diachiip.
Pursuant to Clause 4, Article 17:"Agencies, organizations, and businesses that have been allocated internet addresses may register to use an autonomous system number. The Ministry of Information and Communications uses the records and information submitted when registering internet addresses to allocate an autonomous system number on request."
Detailed rules on the principles for allocating internet addresses and autonomous system numbers, on who may apply for allocation of internet addresses, and on the cases in which the registered holder of an internet address or autonomous system number may be changed, are set out in clauses 2, 3, and 5 of Article 17 of Decree 147.
2. Internet addresses and autonomous system numbers are reclaimed in the following cases:
“a) Under a decision of the Minister of Information and Communications, where internet addresses or autonomous system numbers are reclaimed to serve national or public interests, socio-economic development, national defense, or security, or where they no longer fit the internet resource plan set out inLaw on Telecommunications;
b) Under an administrative penalty decision of the specialized information and communications inspectorate that imposes the remedial measure of reclaiming internet addresses or autonomous system numbers, or the additional penalty of confiscating the means of violation;
c) At the written request of an investigating body or competent state authority under cybersecurity and high-tech crime prevention law, to block the use of internet addresses or autonomous system numbers that infringe national security or social order and safety as provided by law;
d) Internet addresses or autonomous system numbers for which the maintenance fee has not been paid in full within 30 days of the due date;
e) Cases where the registration details for an internet address or autonomous system number are inaccurate, or where the registrant cannot be identified because they have not updated, supplemented, or completed their information.”.
