1. Guiding principles
– The right to use a domain name may be transferred where the conditions in Clause 2, Article 49 of the Law on Telecommunications (Luật Viễn thông) are met, except in the following cases:
+ Domains protected under Article 8 of Circular No. 24/2015/TT-BTTTT, as amended and supplemented by Clause 7, Article 1 of Circular No. 21/2021/TT-BTTTT.
+The domain is subject to an ongoing violation case, is in dispute resolution, or is currently suspended.
– The transfer and re-registration application consists of:
+ A written request to transfer and to accept transfer of internet domain usage rights;
+ The transferee's new domain registration application;
+ Documents showing that the parties to the transfer have paid the tax on the transfer of Internet domain name use rights, in accordance with Ministry of Finance guidance;
– The transferee is eligible to register and use the Internet domain name being transferred under Clause 3, Article 5 of Circular No. 24/2015/TT-BTTTT (Thông tư số 24/2015/TT-BTTTT), as amended and supplemented at Points a, b and c, Clause 5, Article 1 of Circular No. 21/2021/TT-BTTTT.
– The transfer of internet domain usage rights is carried out at the Registrar managing the domain being transferred;
– The parties to a transfer of Internet domain name usage rights complete their transfer tax obligations as instructed by the Ministry of Finance.
2. Steps to follow
