Beta Testing Program Agreement
LEGAL BASIS
- Civil Code 2015 (Article 385 on contract formation, Article 419 on contractual liability);
- Intellectual Property Law (as amended and supplemented in 2022) (Luật Sở hữu trí tuệ) — on confidentiality and intellectual property rights in Beta products;
- Law on Personal Data Protection 2025 (Law No. 91/2025/QH15) and Decree 356/2025/ND-CP;
- The Cybersecurity Law 2025 (Law No. 116/2025/QH15) — on responsible vulnerability disclosure and cybersecurity assurance;
- Digital Technology Industry Law 2025 (Law No. 71/2025/QH15);
- Artificial Intelligence Law 2025 (Luật Trí tuệ nhân tạo 2025, Law No. 134/2025/QH15) — applicable to Beta features with AI components;
- Decision No. 4567/QD-VBPL dated 01/06/2026 issuing the company's Legal Compliance Framework.
This agreement is an appendix to Terms of Service and applies alongside Non-disclosure agreement (NDA) and Personal Data Protection Policy (PDPD). Terms not defined here have the meaning given in the Terms of Service.
PART I - SCOPE AND DEFINITIONS
Article 1. The beta testing program
1.1. The Beta Testing Program is a program under which HiTechCloud invites Customers to trial new features, products or services that have not yet been formally released to the market.
1.2. Products in Beta Testing include: (a) new features of hosting, cloud and AI services that are in development; (b) new versions of the customer management portal; (c) APIs or endpoints under test; (d) entirely new services not yet available on the market.
1.3. “Beta Participant” means an individual or organization invited or approved by HiTechCloud to join the program through the registration process.
Article 2. Eligibility
2.1. Beta participants must: (a) be existing HiTechCloud Customers with an active account; (b) have read and agreed to the Terms of Service; (c) sign a Non-Disclosure Agreement (NDA) before accessing the Beta; (d) undertake to provide genuine, constructive feedback; and (e) not publicly disclose information about the Beta product without permission.
2.2. Where the Participant is an individual under 18, participation requires the consent of a legal guardian under Article 3 of the Terms of Service.
PART II – RIGHTS AND OBLIGATIONS
Article 3. Characteristics of beta products
3.1. Beta participants understand and accept that: (a) beta products are incomplete and may contain defects, missing features and instability; (b) performance, security and availability are not guaranteed to the level of the production service; (c) beta features may be changed, reduced or removed entirely without notice; (d) data created in the beta environment may be lost when the beta period ends; and (e) the service level agreement (SLA) and uptime commitments no applies to the Beta service.
3.2. Participants are responsible for keeping their own independent backups of all important data and must not use the Beta environment for critical production data or operations.
Article 4. Responsible bug reporting and vulnerability disclosure
4.1. Beta participants undertake to: (a) promptly report every bug, performance issue and security issue found, through the beta.hitechcloud.vn portal; (b) describe in detail the steps to reproduce the issue, the test environment and the impact; (c) not publicly disclose any security vulnerability found during the Beta before notifying HiTechCloud and obtaining permission (Responsible Disclosure); and (d) take part in experience surveys on the schedule announced.
4.2. Security testing may only be carried out within the scope HiTechCloud has authorized in writing. Participants must not exploit vulnerabilities, access other users' data, disrupt the service, or engage in any conduct prohibited under Clause 7 of the Terms of Service and in violation of the Cybersecurity Law 2025 (Luật An ninh mạng 2025).
4.3. HiTechCloud credits Participants' contributions in the changelog and release documentation (when the product is officially launched), unless the participant asks to remain anonymous.
Article 5. Confidentiality and non-disclosure of beta information
5.1. All information about a Beta product — including features, interface, performance, defects and product roadmap — is Confidential Information of HiTechCloud, protected under the Intellectual Property Law (Luật Sở hữu trí tuệ) and the NDA.
5.2. Beta participants undertake to: (a) not post, livestream, share their screen, or publicly discuss the Beta product; (b) not provide Beta access to any third party; (c) not publicly compare the Beta product with competing products; (d) delete all Beta data and documentation from their devices once the program ends.
5.3. The confidentiality obligation remains in effect for the duration of Beta participation and for 12 months after it ends or after the product's official release, whichever comes first; trade secrets, however, remain protected until the information ceases to be confidential under the Intellectual Property Law.
Article 6. Intellectual property and feedback
6.1. All intellectual property rights in the Beta product belong to HiTechCloud. This Agreement grants the Participant no ownership rights beyond a limited right of use for testing purposes.
6.2. The Participant agrees that any feedback, comments, or suggestions provided to HiTechCloud may be used freely, without limitation, and free of charge by HiTechCloud to improve and develop its products, without giving rise to any payment obligation or ownership claim for the Participant.
Article 7. Beta participant privileges
7.1. Beta participants receive: (a) early, free access to the Beta feature or service for the duration of the trial; (b) a price concession when the service launches commercially (announced specifically at the end of the Beta); (c) direct influence over the product direction through their feedback; (d) credit in the Beta Tester list (if they consent); and (e) priority technical support while they are taking part.
PART III - LIMITATION OF LIABILITY, DATA, AND TERMINATION
Article 8. Beta-specific limitations of liability
8.1. For Beta services, because the service is free of charge, not yet complete and the Participant is aware of the risks in advance, HiTechCloud's total maximum liability for service level issues, faults, interruptions or loss of Beta data is 0 VND (no compensation). Beta services are provided on an “AS-IS” and “AS-AVAILABLE” basis.
8.2. Exceptions. The limitation in clause 8.1 does not apply to: (a) HiTechCloud's obligations to protect personal data under the Personal Data Protection Law 2025 and the PDPD — which apply in full, including in the beta environment; (b) damage caused by HiTechCloud's wilful misconduct or gross negligence; and (c) liabilities that the law does not permit to be excluded. In all other cases, the general limitation of liability in Article 22 of the Terms of Service applies.
Article 9. Data processing in the beta environment
9.1. HiTechCloud processes personal data arising within the Beta program in accordance with the Personal Data Protection Law 2025 (Luật Bảo vệ dữ liệu cá nhân 2025) and the PDPD. Participants must not upload sensitive third-party personal data into the Beta environment without an appropriate legal basis.
9.2. After the Beta program ends, data in the Beta environment may be deleted. Participants are responsible for exporting any data they wish to keep before the announced end date.
Article 10. Term and termination
10.1. The Beta program runs for the period announced by HiTechCloud. HiTechCloud may end the program or terminate any Participant's participation at any time, without stating a reason and without incurring any liability to compensate.
10.2. HiTechCloud may terminate a Participant's involvement immediately if the Participant breaches its confidentiality obligations (Clause 5), breaches Clause 7 of the Terms of Service, or engages in conduct harmful to the system. The confidentiality obligations and limitation of liability survive termination as set out in this Agreement.
10.3. Disputes arising from this Agreement are resolved under the Dispute Resolution section of the Terms of Service.
This Agreement takes effect once the Participant registers and is approved to join the Beta program. The Vietnamese-language version prevails in case of any legal dispute. By clicking "Agree to Participate" or accessing the Beta environment, the Participant confirms that they have read, understood, and agreed to be bound by this Agreement in full.
