Cloud Server Terms of Use
Legal basis:
- Decree No. 147/2024/ND-CP of the Government: on the management, provision, and use of internet services and online information
- Circular 13/2018/TT-BTTTT of the Ministry of Information and Communications on information system security assurance requirements;
- Cybersecurity Law 2018 (Luật An ninh mạng 2018), Article 26 on protecting information systems and data in cyberspace.
PART I – SERVICE CLASSIFICATION AND DESCRIPTION
Article 1. Cloud Server/VPS service types
1.1. HiTechCloud offers two VPS product lines:
(a) VPS (Virtual Private Server) — basic:
VPS instances use KVM (Kernel-based Virtual Machine) virtualization with fixed resource allocation (vCPU, RAM, disk). Suitable for: small to medium applications, development environments, private DNS servers, and lawful personal or corporate VPNs.
(b) Cloud Server — Advanced:
Cloud servers on VMware vSphere Enterprise Plus / OpenStack, with resources that can be resized directly from the control panel without a rebuild. Suitable for: large production applications, database servers, microservices and enterprise workloads.

PART II – ACCESS RIGHTS AND PERMISSIONS
Article 3. Access and administration
3.1. VPS/Cloud Server customers are granted root access (Linux) or Administrator access (Windows):
(a) SSH (port 22) or RDP (port 3389) with key-based authentication;
(b) VNC console over the web (emergency access when SSH/RDP is unavailable);
(c) Control panel API for automation (restart, resize, snapshot);
(d) A self-managed firewall with rights to create and edit network-level rules.
3.2. With root/Administrator privileges, the Customer has full control over the operating system and software. Responsibility for system security rests with the Customer:
(a) Updating the operating system and software promptly;
(b) Configure the firewall properly (do not leave port 22/3389 open to the whole internet);
(c) Using SSH keys instead of password authentication;
(d) Monitoring resources and system logs.

PART III – ACCEPTABLE USE AND LIMITS
Article 5. Resource usage and limits
5.1. VPS and Cloud Server customers are not subject to the sustained CPU limits that apply to Shared Hosting. The following limits still apply, however, to protect shared infrastructure:
(a) Bandwidth 95th percentile: If traffic consistently exceeds the subscribed plan, HiTechCloud may throttle the connection or charge overage fees;
(b) Anti-spoofing: forging the source IP address (IP spoofing) is strictly prohibited;
(c) Port 25 (SMTP outbound): blocked by default; opened on request once a legitimate purpose is verified;
(d) Network amplification attacks: the system automatically blocks UDP floods, DNS amplification and NTP amplification from the VPS.
5.2. Activities strictly prohibited on VPS/Cloud Server (in addition to Article 7 of the Master Agreement):
(a) Running a botnet or a C&C (command and control) server;
(b) Launching DDoS/DoS attacks against any target;
(c) Sending large-scale email spam from the server;
(d) Running a Tor exit node without HiTechCloud's written consent;
(e) Crypto mining on a VPS plan without a registered mining service;
(f) Storing and distributing infringing content at scale (warez, scene releases).
Article 6. Snapshots, backup and restore
6.1. HiTechCloud provides snapshot and backup features:

6.2. IMPORTANT: VPS Customers are FULLY responsible for backing up their data. HiTechCloud strongly recommends using a third-party off-site backup service or automated snapshots.
Article 7. Networking, IP addresses, and network infrastructure services
7.1. Network configuration:
(a) Every VPS/Cloud Server is allocated at least 1 public IPv4 address;
(b) A free /64 IPv6 prefix is included with every Cloud Server plan;
(c) Private VLAN: you can create an internal network between servers in the same account (free);
(d) Floating and additional IPs: available to rent for a monthly fee;
(e) Minimum uplink: the committed minimum uplink for each service plan; maximum uplink is 3× the plan's committed rate.
