Payment Policy

LEGAL BASIS

  • Luật Kế toán 2015;
  • Tax Administration Law 2025 (Law No. 108/2025/QH15, effective 01/7/2026);
  • Decree 252/2026/NĐ-CP and Circular 89/2026/TT-BTC;
  • Law No. 09/2026/QH16 amending and supplementing a number of articles of the Personal Income Tax Law, the Value Added Tax Law, the Corporate Income Tax Law and the Special Consumption Tax Law;
  • Decree 254/2026/ND-CP and Circular 91/2026/TT-BTC on electronic invoices and documents (effective 1 July 2026);
  • Decree 123/2020/NĐ-CP and Circular 78/2021/TT-BTC apply to the extent they do not conflict with the new framework;
  • Law on Credit Institutions 2024; Circular 23/2019/TT-NHNN;
  • Circular 50/2024/TT-NHNN on safety and security in the provision of online services in the banking sector (which codifies Decision 2345/QĐ-NHNN);
  • Law on Anti-Money Laundering 2022;
  • Decision No. 4567/QD-VBPL dated 01/06/2026 issuing the company's Legal Compliance Framework.

This policy forms an integral part of Terms of Service and applies alongside Refund policy.

PART I - PAYMENT METHODS AND CONDITIONS

Article 1. Accepted payment methods

1.1. HiTechCloud accepts the following methods:

Online payment:

  • International credit and debit cards: Visa, Mastercard, JCB, American Express (through a PCI DSS Level 1 certified payment gateway);
  • Domestic ATM cards (Napas): all banks in the Napas network;
  • E-wallets: MoMo, VNPay, ZaloPay, ShopeePay;
  • Internet banking / bank QR code.

Bank transfer payment:

  • Account name: Công ty Cổ phần Giải pháp Công nghệ và Phần mềm Phổ Tuệ
  • Bank: Military Commercial Joint Stock Bank (MB Bank) – Tay Sai Gon branch
  • Account number: 318222903
  • Transfer reference: [Invoice number] – [Account name]

Business payment:

  • B2B service contracts: exactly as set out in the signed contract;
  • Partners and resellers: under agreed special pricing and separate payment terms.

1.2. HiTechCloud does not accept cash payments over the counter. All transactions must go through electronic channels so that proof of payment exists.

Article 2. Payment currency

2.1. All domestic transactions are priced and paid in Vietnamese dong (VND).

2.2. For international Customers, prices may be quoted in USD but are payable in the equivalent amount converted at the selling rate of the commercial bank handling the transaction, or the State Bank of Vietnam reference rate, at the time of the transaction.

2.3. Any exchange rate differences or foreign currency processing fees charged by the Customer's bank shall be borne by the Customer.

Article 3. Payment security

3.1. Payment transactions are protected by: (a) PCI DSS Level 1 for card processing; (b) SSL/TLS 1.3 encryption for all payment data in transit; (c) 3D Secure (3DS) authentication for international card transactions; (d) real-time fraud monitoring.

3.2. For an individual's electronic funds transfer with a value of over 10,000,000 VND per instance or totaling over 20,000,000 VND/day, authentication is performed under Circular 50/2024/TT-NHNN (Thông tư 50/2024/TT-NHNN) and requires a biometric match combined with an OTP or electronic signature. This authentication requirement is carried out by the bank or payment service provider at the banking transaction layer.

3.3. HiTechCloud does not store full payment card details (full card number, CVV/CVC). All card data is tokenized and encrypted by the third-party payment gateway. Payment data processing complies with HiTechCloud's Personal Data Protection Policy (PDPD).

PART II – INVOICES AND PAYMENT DOCUMENTATION

Article 4. Electronic invoices

4.1. HiTechCloud issues electronic invoices and accounting documents in accordance with the Law on Tax Administration 2025 (Luật Quản lý thuế 2025), Decree 254/2026/NĐ-CP and Circular 91/2026/TT-BTC:

(a) A VAT invoice is issued once payment succeeds;
(b) The invoice includes all of: invoice number, issue date, seller details, buyer details, service description, unit price, and VAT;
(c) The invoice is signed with a valid digital signature and can be looked up on the tax authority's e-invoice portal;
(d) Customers receive invoices at their registered email address and can download them from the account portal.

4.2. To ensure invoices display correct information, corporate Customers must update their full company name, tax code, and registered address before making payment. Requests to correct an invoice after issuance must be submitted within 3 days and will only be accepted where there is valid grounds under the regulations on electronic invoices and documents.

4.3. Payment records, documentation and invoices are retained under the Accounting Law 2015 (at least 10 years) and the Tax Administration Law 2025.

Article 5. Automatic service renewal

5.1. Auto-renewal feature:

(a) By default, the service no renews automatically unless the Customer enables this feature (consistent with Article 8.2 of the Terms of Service);
(b) When auto-renewal is enabled, HiTechCloud sends reminder emails 30, 14 and 3 days before the expiry date;
(c) Auto-renewal only proceeds when the stored payment method is still valid and has sufficient funds;
(d) The Customer may cancel auto-renewal at any time, no later than 24 hours before the renewal date, at no charge.

5.2. Automatic renewal is charged at the price list in force at the time of renewal, which is not necessarily the same as the original registration price. HiTechCloud gives at least 30 days’ prior notice of any price increase affecting an active service.

PART III - HANDLING FRAUD AND PAYMENT DISPUTES

Article 6. Fraud and money laundering prevention

6.1. HiTechCloud applies: (a) mandatory identity verification (eKYC) from 15 June 2026 for new payment accounts; (b) monitoring for anomalies in amount, frequency and geographic location; (c) holds on suspicious transactions pending further verification; (d) customer due diligence, suspicious transaction reporting and other anti-money laundering measures under the Law on Anti-Money Laundering 2022; and (e) cooperation with banks and the authorities where fraud is detected.

6.2. If fraud is detected, HiTechCloud has the right to: (a) suspend the service immediately without prior notice; (b) hold any funds related to the suspected fraud until the investigation is complete; (c) report the matter to the police, given that online fraud to appropriate property may be prosecuted under Article 174 of the Penal Code 2015 (Bộ luật Hình sự 2015).

Article 7. Handling payment disputes (chargebacks)

7.1. If the Customer initiates a chargeback with a bank or card scheme without first contacting HiTechCloud:

(a) The service may be suspended while the dispute is being resolved;
(b) The customer bears the bank's chargeback processing fee (typically 350,000–700,000 VND per transaction);
(c) The account may be suspended where there is a history of fraudulent chargebacks.

7.2. HiTechCloud encourages Customers to get in touch directly by email cskh@photuesoftware.com or the support telephone number before initiating a chargeback with your bank. Disputes relating to refunds are resolved in accordance with the Refund Policy and the Dispute Resolution section of the Terms of Service.

This policy takes effect on 1 July 2026 and supersedes all previous versions. The Vietnamese version is the legally authoritative text.
