1. INTRODUCTION

This disclaimer comprises the conditions, terms and policies published below by which Công ty Cổ Phần Giải Pháp Công Nghê và Phần Mềm Phổ Tuệ disclaims liability toward any organization or individual that accesses, registers for or uses the Company's services through the websites https://hitechcloud.vn and https://photuesoftware.com and through its service servers in any form. All visitors are deemed to have read and understood these conditions and terms carefully and to have accepted every provision voluntarily.

DEFINITIONS:
+ Company: here means Pho Tue Technology and Software Solutions Joint Stock Company, together with its member companies and associated brands, and may also be referred to in short as HiTechCloud, Pho Tue SoftWare Soutions JSC, or We.
+ Visitors: this covers both direct and indirect visitors. A direct visitor is one who knows they are accessing the servers of Công ty Cổ Phần Giải Pháp Công Nghệ và Phần Mềm Phổ Tuệ. An indirect visitor is one who does not know they are accessing Pho Tue SoftWare Soutions JSC servers, including people visiting websites hosted on those servers, search engines and so on.
+ Website: includes the websites https://hitechcloud.vn and https://photuesoftware.com ( clearly noted where specified) and the websites hosted on the Company's servers.
+ Customers: including both direct and indirect customers
+ Direct customers: individuals or organizations that register services directly and hold a service contract with the Company while the service is in “Active” status.
+ Indirect customer: an individual or organization that subscribes to a service through a “direct customer” of the Company while that service is in the “Active” state.

2. LEGAL DISCLAIMER

2.1. All databases stored on the websites https://hitechcloud.vn and https://photuesoftware.com (including subdomains) are owned and managed by Pho Tue SoftWare Soutions JSC. We undertake that all information published there is based on careful research, complies with the law, is provided to the highest standard of reliability, and has been approved by the Board of Directors; we are responsible for that information only toward the “direct customers” using our services. For visitors and indirect customers, the information is provided for reference only. We accept no legal liability for any information relating to the use of any database on https://hitechcloud.vn or https://photuesoftware.com, for any purpose.

2.2. All databases belonging to other websites that are hosted on Pho Tue SoftWare Solutions JSC servers are not owned by the Company; they are owned by the individuals and organizations that are the Company's service customers. We only manage and maintain the service in accordance with the terms of use, and accept no legal liability in respect of those websites.

2.3. The Company accepts no legal liability if a visitor, by any means, downloads, copies, modifies, misrepresents, transmits or publishes to a third party the databases held on its servers.

2.4. Visitors using the database understand that they must follow the website's usage rules. We require, in the strongest terms, that visitors engage in no unlawful or unethical conduct when using the website and the database. Anyone who, having been asked to comply, nonetheless causes harm to the websites or to the Company bears full legal responsibility. The Company will apply every available measure to stop such conduct and will refer it for enforcement under the law.

2.5. The Company accepts no legal liability for the content of any linked website or any link to the website. It accepts no legal liability for any matter arising out of, relating to or resulting from the use or non-use of the website, including but not limited to any software or computer data issue.

2.6. The Company reserves the full right to establish and amend the content of the database at any time. The terms and conditions above are established, amended and interpreted in accordance with Vietnamese law.

2.7. Visitors waive any right to complain, to bring legal action, or to require Pho Tue SoftWare Soutions JSC to intervene in or resolve any matter relating to the content covered by the disclaimer set out above.

3. DISCLAIMER OF LIABILITY

3.1. The Company is not liable where a hardware failure results in data loss, but undertakes to restore the data saved as at the most recent server backup point (where one exists, and depending on the specific service).

3.2. The Company undertakes to maintain the integrity and confidentiality of customer data on the server side. However, we accept no responsibility where a website's database information is exposed.

3.3. The Company undertakes to support “indirect customers”. However, we are not responsible for handling matters relating to an “indirect customer” without the consent of, or a request from, the “direct customer” that provides the service to that “indirect customer”.

3.4. The Company is not responsible for refunds to “indirect customers”.
