Alongside the features Pho Tue SoftWare Solutions JSC has built in to make it easy for customers to get started and manage their website data, we — as the administrators of the Cloud Hosting servers — must maintain stability for every customer on the service, and prevent resource abuse that would affect other websites running on the same Cloud Hosting server.

Accordingly, to protect legitimate users, maintain service quality, and preserve the integrity of our server infrastructure, in addition toGeneral rules for hosting services, you must agree to and accept the specific terms and conditions for the Hosting service set out below:

1. Unacceptable uses:

• Using hosting as backup space, plain storage, or to support storage or share bandwidth and traffic for another website.
• Repeatedly creating and deleting large numbers of files in a way that affects the server's storage system.
• Splitting up the service plan provided in order to resell, sublease, or give it away to others.
• Resharing the service package with third parties (applies to Cloud Hosting packages that use multiple domains, meaning the service is provided to a single customer holding multiple domains and multiple websites owned by that customer or that customer's business).
• Our WordPress Hosting service (formerly Cloud WP) is engineered and tuned specifically for WordPress websites. If you use it to host a non-WordPress website, Pho Tue SoftWare Solutions JSC will suspend the service immediately and notify you; if you have not migrated to WordPress within 24 hours, Pho Tue SoftWare Solutions JSC will terminate the service permanently without refund.
• The website continuously sends or receives a high volume of requests, saturating the network and degrading server performance.

2. Rules on data migration support:

For all hosting plans at Pho Tue SoftWare Solutions JSC, we will migrate your website data from another provider or another hosting location to your hosting at Pho Tue SoftWare Solutions JSC, subject to the following conditions:

• We provide one free website migration from a third-party host to a Hosting server at Pho Tue SoftWare Solutions JSC, immediately after you complete registration and start using the Cloud Hosting service. This is performed only upon customer request and applies only to the first website.
• If you need to migrate one or more additional websites to a Pho Tue SoftWare Solutions JSC server, you need to purchase the Website Migration service.
• You must supply a download link to a compressed backup containing all files, directories and databases. By providing that download link to Pho Tue SoftWare Solutions JSC engineers, you authorize them to carry out the work, and Pho Tue SoftWare Solutions JSC accepts no responsibility whatsoever for information disclosure or for errors caused by missing data after the migration.
• To make sure no data is lost while it is still held by a third party, we ask you to back up your own data at that third party and give us a download link to a compressed archive containing all files, folders, and databases before we start the migration.
• You understand and agree that we do not guarantee the feasibility, success, or completion time of migrating website data from another provider or another hosting location. Each hosting company has a different setup, and some platforms store data in incompatible or proprietary formats, which can make it impossible for us to help you migrate website data from a third-party server.
• You understand and agree that we may refuse to migrate data, or suspend a website after migration, if we find signs of a breach of the terms of service, source code infected with malware or viruses, copyright infringement, and the like. Our technical team will notify you immediately (by email, phone call, SMS, and so on).
• You agree that we are not liable for any delay affecting your website solution in connection with data migration. We cannot guarantee migration timescales, as they depend on factors such as network links, data volume, and server performance…
• Pho Tue Software Solutions JSC accepts no liability of any kind for information leakage, corruption, or data loss during a data migration.
• You agree not to make any changes or updates to the website while we are carrying out the data migration.
• We cannot guarantee your website configuration after a data migration, because we cannot make deep changes to your source code, cannot know its structure in detail, and are not a development shop. We will do our best to help within the limits of our knowledge; working with your web developer will get this done faster.

3. Limits that apply to the hosting service:

You are entitled to use 100% of the resources Pho Tue SoftWare Solutions JSC has allocated to you under the hosting package you have subscribed to. If you exceed that allocation, your website may become slow or unreachable, returning 500, 503 or 508 errors in the browser, and may even be suspended to prevent escalating resource consumption from affecting server performance.

You understand and agree that if any unusual activity on your website creates a security risk or affects our systems, we will intervene immediately and suspend it to prevent resource escalation and protect overall server performance. We will notify you as soon as we detect the anomaly so that you can investigate and resolve it yourself, or our engineers can advise you on a solution. If the problem is not fully resolved within 24 hours of our notification, or if it recurs and affects server performance, we may unilaterally terminate the service without refund, depending on our assessment of how seriously it affects our servers.

When using hosting, you must understand and accept the following limits:

• Database: must not exceed 1,000 tables and must not exceed 1 gigabyte of storage per database (including logs). Query and statement execution against the database must not exceed 15 seconds. This policy applies to all hosting plans except the WordPress Ecom plan.
• The WordPress Ecom service limits each Database to 2,000 tables and 2 GB of storage, including logs.
• Email supplied with hosting (where included) is limited to 100 emails per day across the whole domain.
• Storage capacity for the Email service bundled with cloud Hosting does not exceed 1000 MB.
• All Windows Hosting plans are limited to a maximum of 300,000 files and folders per account.
• Hosting services do not permit storing individual files larger than 100 megabytes (this does not apply to databases in active use). Files stored on the server must serve the operation of the website; this space may not be used to store personal data or compressed archives.
• Note: any hosting Account that exceeds these limits may be issued a warning for breach of the terms of service and required to reduce its number of inodes, files, directories and tables, and its database size, to bring the account back within the service usage policy. Depending on how seriously we assess the impact on our servers, the service may also be suspended or terminated without refund.

4. Outside the scope of support:

We always try to help with service-related issues so that your experience is easier and your website runs on a well-operating platform. Some situations are genuinely outside our control, however, and the following fall outside our scope of support, including but not limited to:

• We do not test or fix website compatibility across multiple browsers or on mobile devices.
• We do not troubleshoot network issues, applications or third-party services (that is, services not supplied by Pho Tue SoftWare Solutions JSC).
• We do not troubleshoot issues caused by the customer's computer, device, or web browser on their computer or mobile device.
• Hosting services do not permit storing individual files larger than 100 megabytes (this does not apply to databases in active use). Files stored on the server must serve the operation of the website; this space may not be used to store personal data or compressed archives.
• We do not edit, customize, or optimize a website's source code or images.
• We do not modify or adjust data held in databases.
• We cannot make deep programming changes to fix errors in a website's source code.
• We do not install or configure SEO for a website.
• We cannot guarantee recovery of files damaged by viruses or malware.
• We cannot guarantee to resolve website slowness caused by how the website's own source code, images, JS, or CSS are handled.
• We do not resolve issues where network attacks slow a website down because of security vulnerabilities within the website itself.
• We do not reset the password for a website's admin panel (the website's administrator account password).
• Pho Tue SoftWare Solutions JSC staff do not provide Cloud Hosting admin passwords directly. You can log in at client.hitechcloud.io.vn or my.photuesoftware.vn to retrieve your password, or log in directly to the Hosting Control Panel without needing the admin account credentials.
• We do not install new software or upgrade software on the server platform solely to meet the needs of a few individual websites.
• We do not perform or assist with any custom root or Administrator-level operations on the server.
• We do not perform backups or supply backup files. Customers can back up their own data on a regular schedule through the control panel.
• We block the execution of certain PHP functions for security reasons (malware distribution, local attacks, botnets, denial of service and so on). Hosting providers worldwide rate these functions as very high risk. Specifically, the following PHP functions are not supported on Cloud Hosting servers at Pho Tue SoftWare Solutions JSC: system, exec, shell_exec, pcntl_exec, proc_close, proc_get_status, proc_nice, popen, proc_terminate, escapeshellcmd, escapeshellarg, dl, show_source, ini_alter, virtual, openlog, mail, symlink. For details, seehere.

5. Specific terms and conditions for the WordPress Hosting 2023 service:

5.1.All WordPress Hosting 2023 service plans are designed to support only websites built on WordPress, withversion 4.0 or later. You must therefore understand and agree that any account on the server found to be usingwebsites not built on WordPressorWordPress installations on versions below 4.0may be issued a warning for breach of the Terms of Service and have the service suspended; if within 24 hours you have not replaced it with WordPress source code version 4.0 or later, Pho Tue SoftWare Solutions JSC will terminate the service permanently with no refund.

5.2.ServicesWordPress Hosting 2023 does not support Email service bundled with Hosting.

5.3.We migrate your website from a third-party provider to a Pho Tue SoftWare Solutions JSC WordPress Hosting 2023 server free of charge, once only, immediately after you complete registration and begin using the service. You must understand and agree that:

• You must give our technical staff the full login details for the third-party hosting account / FTP account so that they can carry out the work.
• We may install a plugin on your WordPress site to help migrate the site to a server at Pho Tue SoftWare Solutions JSC. The plugin does not alter your source code or data in any way; it is used solely to move the WordPress files. You are free to disable the plugin once the migration to Pho Tue SoftWare Solutions JSC is complete.
• We accept no responsibility for anything relating to your data, including: information leakage, data loss or gaps, and website errors caused by missing data.

5.4.To maintain performance in a WordPress environment, plugins should be reviewed carefully before you install and use them. You understand and agree that if any plugin behaves abnormally in a way that creates a security risk or affects the system, we will act to remove or suspend it immediately to prevent resource escalation and disruption to the wider server. We will notify you as soon as we detect such behavior so that you can investigate and resolve it, or our specialists can advise you on an alternative. If the problem is not fully resolved within 24 hours (after we send the notice), or if it recurs and affects server performance, we may unilaterally terminate the service without refund, depending on how seriously we assess the impact on our server.

5.5.You must understand and agree that, if our system detects that your WordPress website is using one of the Plugins listedPlugin blacklistwill be removed immediately because they affect the security and performance of the server.

5.6.You agree that, while we are investigating and fixing faults or optimizing your website's performance and speed, we may install certain plugins into your WordPress site to make that investigation and remediation possible under your support request. Any plugins we install are guaranteed not to affect your website data. Before installing them, a Pho Tue SoftWare Solutions JSC support agent will contact you to explain and notify you (by email, phone call or SMS). In some cases, plugins installed by Pho Tue SoftWare Solutions JSC may conflict with plugins already present on your site; if that happens, we will advise you on a suitable alternative.

5.7.Conditions for upgrading to the WordPress Hosting 2024 service:

The following conditions apply only where a customer wants to switch or upgrade from the plansLinux Hosting, Windows HostingandWordPress Hostingto the plansWordPress Hosting 2024:

5.7.1.We support migration and hosting only for websites built on WordPress version 4.0 or later. You must understand and agree that we will decline to migrate and host a website if its source code is not WordPress, or if the WordPress version in use is below 4.0.

5.7.2.Email service included with plansLinux Hosting, Windows HostingandWordPress Hosting (formerly Cloud WP)will no longer be maintained after upgrading or switching to the plansWordPress Hosting 2024 v1.

Note: you can keep the email service running alongside the plansLinux Hosting, Windows HostingandWordPress Hosting (formerly Cloud WP)by ordering our Professional Email plan.

6. Specific terms and conditions for the WordPress Hosting v4 and WordPress Hosting v5 services:

6.1.All service plansWordPress Hosting v4andWordPress Hosting v5at Pho Tue SoftWare Solutions JSC are designed exclusively for websites built on WordPress, withversion 5.0 and lateror higher. You understand and agree that if our server systems detect any account hosting source code that is not WordPress version 5.0 or higher (except for static files such as html, css, js, png, jpg, mp3, mp4, etc.), that account will be suspended as it is not compatible with the hosting system designated for these plansWordPress Hosting v4andWordPress Hosting v5. You can ask us to move you to a more suitable hosting service, such as Linux Hosting, Windows Hosting, Cloud Server, …

6.2.ServicesWordPress Hostingsupports the email service bundled with hosting.

6.3.We migrate websites from third parties to our servers free of chargeWordPress Hostingof Pho Tue SoftWare Solutions JSC on a one-time basis immediately after you complete registration and begin using the service. You understand and agree that:

• You must provide one of the following so that our technical team can migrate your website quickly:
  • The third-party hosting or FTP account (where your website data is currently stored).
  • Your WordPress site administrator account.
  • The download link for the website backup file (zip, tar, rar and so on).
• We may install a plugin on your WordPress site to help migrate the site to a server at Pho Tue SoftWare Solutions JSC. The plugin does not alter your source code or data in any way; it is used solely to move the WordPress files. You are free to disable the plugin once the migration to Pho Tue SoftWare Solutions JSC is complete.
• We accept no responsibility for anything relating to your data, including: information leakage, data loss or gaps, and website errors caused by missing data.

6.4.We upgrade your website to WordPress 5.0 or later free of charge from the initial support steps onward, subject to the following conditions:

• Applies only to service plansWordPress Hosting v4andWordPress Hosting v5.
• Applies only to WordPress websites running versions 4.3 to 4.9.
• Where it is not possible to upgrade to WordPress 5.0 or later, we will still allow the website to run on a version below 5.0 — but you must understand and agree that we will be obliged to install security plugins (such as Wordfence or iThemes Security Pro) and apply our own security configuration measures to your WordPress site, so that it can run safely on the serverWordPress Hosting v4andWordPress Hosting v5 của chúng tôi.

6.8. Conditions for upgrading to the WordPress Hosting v5 service:

The following conditions apply only where a customer wishes to switch or upgrade from a Linux Hosting, Windows Hosting, WordPress Hosting or WordPress Hosting v4 plan to a WordPress Hosting v5 plan:

6.8.1. We support migration and hosting only for websites built on the WordPress codebase. You must understand and agree that we will decline to migrate and host a website whose codebase is not WordPress (with the exception of static files such as html, css, js, png, jpg, mp3, mp4, etc.).

6.8.2. The Email service bundled with the Linux Hosting, Windows Hosting and WordPress Hosting (formerly Cloud WP) plans will no longer be maintained once the plan has been upgraded or migrated to WordPress Hosting v5.

Note: you can keep the email service running alongside the plansLinux Hosting, Windows HostingandWordPress Hosting (formerly Cloud WP)by ordering our Professional Email plan.

6.9. We share a library of premium WordPress themes from Envato free of charge; you understand and agree that:

• Applies only to registered services that areWordPress Hosting v4, WordPress Hosting v5, WordPress Ecom.
• You may choose any theme from the list of WordPress themes we provide. Once the theme is installed, we will import the demo data (sample data) one time only; you can refer tohereto enter your real data on the website.
• We do not provide technical support for these freely shared WordPress themes; you can visithereto view the usage guide from the theme's publisher.
• We accept no responsibility for anything relating to your data, including: information leakage, lost or missing data, website errors, and missing data originating from a theme.

6.10.We also provide a purpose-built plugin with features covering security, SEO, SMTP and contact channels. The plugin is called WP Helper. You can read a detailed description of its featureshere. To use the WP Helper plugin, you understand and agree that:

• The plugin is installed automatically from our hosting management tool.
• The plugin we ship does not affect your website data.
• In some cases a plugin we publish may conflict with plugins already present on your website; if that happens we will advise you on a suitable alternative.
• You can delete or disable our plugin if you do not consider it necessary.

7. Specific terms and conditions for the Managed WordPress Hosting service, abbreviated as PWP:

Services PWP covering the general terms for hosting services,the terms and conditions of the WordPress Hosting 2023 service(in Section 5 – Under this agreement). When using the PWP service, note thatseparate terms and conditionsas follows:

7.1 WordPress website optimization rules:

a.Given the specific nature of the PWP service, our specialists apply a number of dedicated configurations to optimize WordPress site performance for security and speed.

b.We do this free of charge, limited to the first website on the PWP plan.

c.WordPress optimization is only performed on version 4.0 or later.

7.2 Backup policy:

a.For the MWP service, we configure website data backup and retain it14 consecutive daily backupsto give customers more options for restoring data when needed.

b.You understand and agree that We bear no liability of any kind for damage, loss, or missing data resulting from errors that may occur in the backup process on the backup system. We recommend that you regularly back up your website data yourself and save it to your personal computer.

c.We do not support restoring backups in which files are infected with malware / viruses, …

7.3 Plugin policy:

a.You agree that when you use the MWP service, we will install a plugin thatoptimize website securityto give your website the best possible performance.

b.Our WordPress plugin scanner runs daily. You understand and agree that if our security system detects that your WordPress website is using one of the plugins listed inPlugin blacklistthen that plugin will be removed immediately.

8. Specific terms and conditions for the WordPress Ecom service:

The WordPress Ecom service is governed by the General Regulations on hosting services and the service Terms and ConditionsWordPress Hosting v4andWordPress Hosting v5(in section 6 – of this agreement) and the PWP service (in section 7 – of this agreement). When using the WordPress Ecom service, note the following specific terms and conditions:

8.1WordPress optimization guidelines:

a.Given the nature of the WordPress Ecom service, our specialists apply a number of specific configurations to optimize the performance of the WordPress website for security and speed.

b.We perform free website optimization, limited according to the WordPress Ecom plan.

c.WordPress optimization is only performed on version 5.0 or later.

9. Policy on the WordPress website optimization solution and the WordPress Performance tool:

9.1.For advanced WordPress optimization solutions, we proceed only under the following conditions:

• Applies only to websites running WordPress v5.0 or later.
• The first advanced optimization is free. From the second time onward, a solution fee applies.
• Advanced WordPress optimization work is only carried out for websites hosted on Pho Tue SoftWare Solutions JSC servers.
• Applies only to the following WordPress Hosting plans within the servicesWordPress Hosting 2023, WordPress Hosting v3:
  • ✔ Retail stores.
  • ✔ Enterprises.
  • ✔ Premium.
  • ✔ Optimized.
• Applies only to the following WordPress Hosting plans within the servicesWordPress Hosting v4andWordPress Hosting v5:
  • ✔ SHOP.
  • ✔ BUSSINESS.

Note: If your website is hosted on a Hosting plan not listed above, you need to upgrade in order to receive support for the advanced WordPress optimization solution.

9.2.We make no commitment regarding speed scores from measurement tools such as Google PageSpeed, GTMetrix, Pingdom, …

9.3.You understand and agree that we measure the effectiveness of optimization against the following actual factors:

• The themes and plugins you use on the WordPress website.
• Size: the number of requests, images, JS and CSS files, etc., used by the WordPress website.
• The tasks are listed according toWork items for WordPress website optimization.
• Page load speed before and after optimization.

9.4.We provide a warranty entirely free of charge for the WordPress website optimization solution. You understand and agree that the warranty for the WordPress website optimization solution is valid only while your website is still hosted and running on the service’s serversCloud WP Hosting(legacy WordPress Hosting plan),WordPress Hosting 2019, WordPress Hosting v3, WordPress Hosting v4, WordPress Hosting v5, Managed WordPress (MWP), WordPress Ecomat Pho Tue Software Solutions JSC.

9.5.We do not provide a warranty for the WordPress optimization solution in the following cases (including but not limited to):

• The customer changed the theme in a way that affected website performance.
• The Customer installs, edits, deletes or replaces other Plugin(s) that fall outside the items we have previously optimized.
• The Customer uses nulled themes or plugins downloaded from unverified sources.
• Data loaded from external links such as: Google, Facebook, Instagram, Twitter, Livechat, …

9.6.You agree that our WordPress experts may arrange an estimated schedule and a specific time convenient for carrying out the work. Immediately after you complete registration for the WordPress website optimization solution, our experts will contact you with details via your phone number.

9.7.For the WordPress Performance automatic optimization tool:

• Results measured after optimization can vary at times, depending on Internet connectivity conditions or on the structure of the individual website.
• The tool makes no change at all to the structure of the WordPress site's source code. You understand and agree that we accept no liability of any kind for damage to, or loss of, data should the optimization process on our systems encounter an error. We recommend backing up your website data before running it.
