Welcome to Pho Tue SoftWare Solutions JSC (hereinafter referred to as“Pho Tue SoftWare Solutions JSC”, “HiTechCloud”, “Hi-Tech Cloud”or“we”). Please read this Agreement carefully before registering for or using the Services at Pho Tue SoftWare Solutions JSC, as it contains provisions bearing directly on your rights and obligations while using the services at Pho Tue SoftWare Solutions JSC.

The website and the Services offered on www.hitechcloud.vn are owned by Pho Tue SoftWare Solutions JSC. By using this website and these services, you agree to the terms set out in this Terms of Service Agreement (hereinafter referred to as“Pho Tue SoftWare Solutions JSC”).

Based on business practice and legal requirements, we reserve the right to amend, update, add to, or remove part or all of the content of the PTG Terms without being obligated to notify you directly, though we will publish the change publicly on our website.

You agree that if you continue to access our website and/or use Pho Tue Software Solutions JSC services after the terms of service have been updated or supplemented, you accept and agree to be bound by the updated PTG terms. You should review the PTG each time you visit the website, and you can view the latest version at any time at:https://hitechcloud.vn/phap-ly/

If one or more provisions of the PTG conflict with the law and are declared void by a court, that provision will not apply and will be amended to conform with current law; the remaining provisions of the PTG remain in force.

The following pages bring together the usage policies in force at Hi-Tech Cloud, as part of the terms of use that connect the service provider and Hi-Tech Cloud's customers. Reviewing the documents and terms on this page gives you the information you need while using the service. These terms are amended from time to time, as required, to reflect how the service is used and delivered.

Article 1: Definitions

“Pho Tue SoftWare Solutions JSC”: Công ty Cổ Phần Giải Pháp Công Nghệ và Phần Mềm Phổ Tuệ.

“Hi-Tech Cloud by Pho Tue SoftWare Solutions JSC , HiTechCloud hay Hi-Tech Cloud”: is a brand of Công ty Cổ Phần Giải Pháp Công Nghệ và Phần Mềm Phổ Tuệ.

“We”: HiTechCloud, Pho Tue SoftWare Solutions JSC and its parent companies, subsidiaries, branches and related companies, affiliated organizations, officers, employees, representatives, partners and licensees of Pho Tue SoftWare Solutions JSC.

"You", "Customer", "Client": a person who visits this website and/or is using and/or lawfully owns the products and services provided by Pho Tue SoftWare Solutions JSC under the applicable policies of Pho Tue SoftWare Solutions JSC and under the applicable law.

“Email”, “Mail”: short for “Electronic Mail”, rendered in Vietnamese as “Thư điện tử”. Email (or mail) is the means used to send and receive content and exchange information over the Internet.

“NameServer”, “DNS”: Is the domain name resolution system on the Internet. Put simply, DNS is a system that converts an easy-to-remember domain name (for example, www.tenmien.com) into a hard-to-remember IP address (for example, 192.168.1.100).

“Email Admin”, “Registrant Email”: the email address used for verification when registering an international domain name. ICANN, the international domain name authority, requires that an international domain name be verified from the registrant's email address when it is registered or when its details change.

“Admin”: Admin is short for “Administrator”, meaning manager, administrator or system operator. This is the highest level of administrator privilege when working with storage systems or with system administration.

“Download”: Downloading data from the internet to a computer.

“File”: a named file stored on storage media such as a hard disk, floppy disk, USB drive, CD, DVD, …

“License Key”: the code (also called a key) for licensed software, issued by the software vendor. During installation or use, software that has not been activated will require you to activate it before you can continue using it.

“Control Panel”: An English term. In Vietnamese it is rendered “Bảng điều khiển” (control panel) — a tool that lets users administer systems through a visual interface, for example: Cloud Hosting, Cloud Server, Email, DNS, ID, …

The services of Pho Tue SoftWare Solutions JSC are the products and services published on this website (hereinafter referred to as“Services”).

Article 2: Acts prohibited when accessing the website and/or using the services:

You are prohibited from using the service you have purchased for any purpose and in any form that violates Vietnamese law, the international law governing the service, or the international conventions to which Vietnam is a party, including but not limited to the following acts:

2.1 You store, link to, distribute or relay data that:

Content that is unlawful or banned from distribution by the State: advertising, promoting or trading prohibited goods and services; distributing banned journalistic, literary or artistic works and publications;
Opposing the Socialist Republic of Vietnam; harming national security or social order and safety; undermining the great national unity bloc; propagating war or terrorism; inciting hatred or conflict between nations, ethnic groups or religions;
Propagating or inciting violence, obscenity, depravity, crime, social evils, or superstition, or undermining the nation's fine traditions and customs;
Publishing distorted or slanderous information that damages the reputation of an organization or the honor and dignity of an individual;
Disclosing state secrets, or military, security, economic, foreign-affairs or other secrets defined by law, in any form that Vietnamese law prohibits.

2.2 You store or distribute data that may constitute or encourage unlawful conduct, including infringement of intellectual property rights — including but not limited to infringement of copyright and related rights, infringement of industrial property rights (trademarks, trade secrets), or other conduct that infringes the lawful rights and interests of other organizations and individuals.

2.3 You upload, post, email, transmit, or otherwise make available any material containing software viruses or other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer hardware, software, or telecommunications equipment.

2.4 You commit fraud or act in breach of this agreement or of the relevant provisions of law in relation to the websites and addresses of service providers affiliated with us.

2.5 You impersonate any organization or individual, including but not limited to any officer, forum moderator, guide, host or employee of Pho Tue SoftWare Solutions JSC, and/or you distribute or promote fabricated or false information in order to misrepresent the standing of another individual or organization and infringe their lawful rights and interests.

2.6 You use the Services (Web Hosting, Email Plus, etc.) beyond the allotted resources, or breach the rules applicable to each Service type of Pho Tue SoftWare Solutions JSC set out in the Final Terms.

2.7 You obstruct or disrupt the service, or other people's use of the service, the servers or the networks linked to the service; or you fail to comply with the requirements, procedures, policies or rules of the networks connected to the service.

2.8 You breach the anti-spam rules in Decree 91/2020/ND-CP (Nghị định 91/2020/NĐ-CP) on combating spam messages, spam email and spam calls, or any legal instrument in force at the time the spam is sent.

2.9 You use the service in a way that harms, or may harm, minors in any form.

2.10 You breach the current regulations of the Ministry of Information and Communications, or current Vietnamese law on unlawful conduct on the Internet, beyond the cases described in this Article.

2.11 You misuse the ICANN or Pho Tue SoftWare Solutions JSC logo on your website, or hold yourself out as an ICANN Registrar without ICANN's authorization.

Article 3: Rights and obligations of the customer

As a customer, you have the full rights and obligations of the Service Recipient under applicable law, specifically as set out in https://hitechcloud.vn/van-ban-phap-ly/ and other relevant legal provisions.

3.1 You must have the legal standing and capacity required by law to enter into a contract with Pho Tue SoftWare Solutions JSC. You confirm that you are not a person lacking or restricted in civil capacity, not bound by a third party, not subject to a judgment or decision of a competent state authority, and not prohibited from entering into civil transactions relating to the services of Pho Tue SoftWare Solutions JSC. You further confirm that you will not use information belonging to, or infringe the rights of, any third party when registering for services from Pho Tue SoftWare Solutions JSC, when providing information to Pho Tue SoftWare Solutions JSC, or when using the services you have registered, unless that third party has given permission — and that you accept sole responsibility for any unauthorized use of such information.

3.2 You must provide the information requested once Pho Tue SoftWare Solutions JSC issues a verification request, and you are legally responsible for the purpose for which the information is used and for its accuracy. You must ensure that registration and use of the service comply with the law and do not infringe the lawful rights and interests of other organizations or individuals. If your information changes and you do not notify Pho Tue SoftWare Solutions JSC within 07 days of the change, or you do not respond to a verification request from Pho Tue SoftWare Solutions JSC within the notified deadline, Pho Tue SoftWare Solutions JSC may suspend or cancel your registration.

3.3 You are directly responsible for managing and maintaining your right to use your services, and you bear full responsibility for any violation of the service usage rules or any issue caused by lax management on your part. You must provide truthful, complete information as requested by Pho Tue SoftWare Solutions JSC or a competent authority within the prescribed time limit.

3.4 You must provide the following information in full when registering for services with Pho Tue SoftWare Solutions JSC:

a) For agencies, organizations, and businesses:Name of the agency, organization or enterprise; the organization's electronic identification code; enterprise registration number; tax code; full address of the head office; telephone number; email address;

If you register a domain service, you must also supply the domain administrative contact details; the domain technical contact details; the details of the organization or individual paying the domain registration fees and charges; the intended use of the domain where it is registered to set up an aggregated information website, social network or online newspaper; and you must update the stated purpose of use whenever it changes;

b) For individuals and household businesses: the individual's full name;the household business name; the full name of the household business owner or representative; date of birth; personal identification number or passport number, place and date of issue; household business registration number; household business tax code; full permanent residential address including house number; full temporary residential address including house number; phone number; email address.

You also need to provide name server details (primary and secondary).

Pho Tue Software Solutions JSC receives and stores information relating to the registrant's personal data and discloses it to relevant parties only at the request of competent authorities.

While using and maintaining the service, you may submit a request to Pho Tue SoftWare Solutions JSC to change the information above. If the registrant's details change, the service user must notify Pho Tue SoftWare Solutions JSC in writing within 07 days of the change, so that the information remains accurate and complete. Pho Tue SoftWare Solutions JSC accepts no legal liability, no obligation to compensate and no joint liability for any consequence or damage arising from your failure to comply with this requirement.

3.5 Within 10 days of successfully registering for the service, you must send the following documents to Pho Tue SoftWare Solutions JSC: one (1) original valid identity document (such as a citizen identity card, ID card or passport), or a copy certified within the last 06 months where a copy may be substituted for the original; or, for organizational customers, one (1) original service contract bearing the company seal, together with any other reasonable documents Pho Tue SoftWare Solutions JSC may require for each service registered.

If the documents are not submitted within the period stated above, the registered service will be suspended or revoked without refund. The service will be restored only if you submit the documents to Pho Tue SoftWare Solutions JSC and no changes have been made to the service details registered in the system. Pho Tue SoftWare Solutions JSC cannot and will not be liable for any legal consequences, and has no obligation to compensate or share liability for any loss or damage arising from your failure to comply fully and diligently with this provision.

3.6 If the customer is a business or organization, you and your authorized staff are responsible for keeping password and account information confidential, and are jointly responsible for activity carried out using your password or account.

3.7 Any dispute arising from or related to the use of a domain name shall be resolved through mediation and negotiation. If the Parties cannot resolve the dispute through negotiation, either Party is entitled to bring it before a competent court for resolution in accordance with Vietnamese law.

3.8 You are responsible for indemnifying and holding harmless the relevant parties of Pho Tue SoftWare Solutions JSC against any claims, liabilities, costs and losses arising from or relating to your registration and use of your domain name.

3.9 You are responsible for maintaining: (1) the confidentiality of your account password; and (2) all activity that occurs on or through your account. If your password or account is used without authorization, you must notify us immediately and change your password promptly to protect your information. Pho Tue SoftWare Solutions JSC may close your account at any time if necessary for information security reasons. Pho Tue SoftWare Solutions JSC cannot and will not be liable for any loss, damage or other liability arising from your failure to comply with this provision or from unauthorized access to your account.

3.10 You are solely responsible for all content stored on Pho Tue SoftWare Solutions JSC servers.

3.11 You are solely responsible for applying measures to prevent any damage to or destruction of the website content or the server's resources.

3.12 You understand and agree that Pho Tue SoftWare Solutions JSC backs up its hosting services for the purpose of recovering from technical, infrastructure and hardware failures, not for the purpose of providing copies to customers. You are therefore responsible for regularly backing up all of your data stored on Pho Tue SoftWare Solutions JSC servers and keeping those backups safe. Backups can be taken using the tools Pho Tue SoftWare Solutions JSC provides (cPanel, Plesk or the control panel). Pho Tue SoftWare Solutions JSC accepts no responsibility whatsoever for any loss, damage or error relating to your data.

3.13 You are responsible for keeping your own login credentials secure when using services at Pho Tue SoftWare Solutions JSC. These include: the service administration account ID (at client.hitechcloud.io.vn or my.photuesoftware.vn), the Control Panel, email accounts, and the like.

3.14 You are responsible for complying with intellectual property regulations and policies, including but not limited to: copyright and related rights; industrial property rights including trademarks, trade secrets, and the like, when using services at Pho Tue SoftWare Solutions JSC.

3.15 You understand and accept that We may contact you directly by means including but not limited to email, SMS, automated calls (autocall) and pre-recorded calls, for the purposes of notification, consultation, marketing, support, promotional information, news, documentation and service guides. You also acknowledge and agree that our sending you email does not constitute spam. In addition, your calls may be recorded so that we have a basis for quality monitoring and service improvement, and you consent to this.

3.16 How to unsubscribe from communications from Pho Tue SoftWare Solutions JSC:

We run advertising, marketing, and news campaigns to support our business, send promotional information, and share useful knowledge with users. You can ask us to stop sending you this information by:
- Click the option “Unsubscribe” or “Unsubscribe” in the body of the email you receive.
- Create a ticket from the service management portal (client.hitechcloud.io.vn or my.photuesoftware.vn).
When you request to unsubscribe, you understand and agree that:
- You may no longer receive important information.
- We will try to remove your subscription details from every list, but some may be missed, so you might still receive messages in certain categories.
Certain itemsrequiredthe following cannot be unsubscribed from, including but not limited to:
- Service registration or renewal notices.
- Notice regarding the Terms of Service.
- Scheduled maintenance notices.
- Service guides and support.
- Resource and security alerts.
- Urgent notices.

Article 4: Rights and responsibilities of Pho Tue SoftWare Solutions JSC

As a service provider, Pho Tue SoftWare Solutions JSC holds all the rights and obligations of a supplier of services under applicable law, specifically underhttps://hitechcloud.vn/van-ban-phap-ly/and other relevant legal provisions.

4.1 Pho Tue SoftWare Solutions JSC undertakes to support customers in using the products and services it supplies, for as long as the customer uses Pho Tue SoftWare Solutions JSC services and within the scope of its authority as a domain registrar. All of your rights and obligations are based on the account information you have registered; if any of that information is inaccurate, Pho Tue SoftWare Solutions JSC accepts no liability where the inaccuracy affects or limits your rights, and will not take it upon itself to change your data if the information you provided is unsuitable or incorrect.

4.2 Receive and resolve customer complaints relating to the service or service quality arising during the customer's use of Pho Tue SoftWare Solutions JSC's products and services, provided the customer has supplied complete, truthful, and accurate information as required under Article 3 of this PTG, and within the scope of the domain registrar's responsibility.

4.3 Pho Tue SoftWare Solutions JSC is responsible for implementing preventive measures to protect data against loss, misuse, unauthorized access, or destruction. Pho Tue SoftWare Solutions JSC is entitled to require you to cooperate in verifying information if it suspects that the information provided is inaccurate or has been falsified.

4.4 Depending on the severity and nature of the customer's violation, Pho Tue SoftWare Solutions JSC has the right to unilaterally suspend, cancel, or terminate the provision of the service under Article 7 of this policy and/or refer the matter to the competent authority to request resolution in accordance with applicable law.

Article 5: Payment rules

5.1 By ordering the service, you agree to follow our payment instructions here:https://hitechcloud.vn/chinh-sach-thanh-toan/. Pho Tue SoftWare Solutions JSC cannot and will not be liable, and has no obligation to compensate, for any consequence or damage arising from your failure to fully comply with these payment provisions.

5.2 Pho Tue SoftWare Solutions JSC will issue an electronic invoice once payment has been received in full from you and the service has been successfully activated. The electronic invoice is issued to the entity registered as the owner of the service.

Example:

Example 1: if the service is registered in the name of XYZ Joint Stock Company, then Pho Tue SoftWare Solutions JSC issues the electronic invoice to XYZ Joint Stock Company and may not issue an invoice to any other company or individual.

Example 2: if the service is registered under the registrant name Mr. Nguyễn Văn A (Mr. A may be the director or contact person of XYZ Joint Stock Company), Pho Tue SoftWare Solutions JSC will issue the electronic invoice only to Nguyễn Văn A, not to XYZ Joint Stock Company.

Article 6: Service renewal rules

6.1 You, or the service administrator you designate (in the case of a business or organization), are responsible for proactively monitoring the operational status and validity period of the products and/or services registered with Pho Tue SoftWare Solutions JSC.

6.2 Customers should contact Pho Tue SoftWare Solutions JSC and complete their renewal and service fee payment 10 (ten) days before the Service expiry date. A renewal takes effect only once Pho Tue SoftWare Solutions JSC has received the service fee in full. The renewal is completed within 03 days of Pho Tue SoftWare Solutions JSC receiving the full renewal fee.

6.3 Auto-renewal rules (Auto Renew):

· To reduce the risk of a service interruption caused by a missed renewal, Pho Tue SoftWare Solutions JSC offers automatic renewal. The feature runs when your service is close to expiry (10 days before the expiry date): the system extends the term using the bank credit card you have registered and authorized (see also the payment security agreementhere).

· Services you newly subscribe to on a monthly basis have auto-renewal enabled by default.

· You can view or change the auto-renewal setting at any time by logging in to your service management account at client.hitechcloud.io.vn or my.photuesoftware.vn.

· If you use the automatic renewal feature in the client portal at client.hitechcloud.io.vn or my.photuesoftware.vn, that is simply a facility Pho Tue SoftWare Solutions JSC has built to help you manage renewals yourself; it remains subject to every provision of this Article 6. In other words, in all cases you remain responsible for actively monitoring the operational status and expiry dates of the products and services you have registered with Pho Tue SoftWare Solutions JSC.

6.4 Pho Tue SoftWare Solutions JSC cannot and will not accept liability or pay compensation for any consequence or loss arising from your failure to comply with these rules.

Article 7: Suspension and termination of service use

7.1 Services provided by Pho Tue SoftWare Solutions JSC will automatically terminate or be suspended by agreement of the two parties, or when the contract expires, except as provided in Article 7.2 of this Agreement.

7.2 Pho Tue SoftWare Solutions JSC may unilaterally terminate the service contract in the following cases:

7.2.1 You breach the provisions of this PTG, the final Article: PTG's terms of service, and the other related Contracts and Appendices, in the course of using our products and services.

7.2.2 You fail to cooperate or to provide the additional documentation required under Article 3.5 of these Terms.

7.2.3 At the request of a competent State authority and/or of the Provider in respect of the corresponding Services.

7.2.4 You fail to renew and pay Pho Tue SoftWare Solutions JSC the outstanding fees within 10 days of the Service's expiration date. Pho Tue SoftWare Solutions JSC bears no responsibility for resolving cases of non-payment or late payment of the above fees.

7.2.5 Other cases as provided by law.

7.3 Before terminating your service, you are responsible for migrating all data stored on Pho Tue SoftWare Solutions JSC servers yourself. We will not transfer or FTP your data to another provider. If you do not move your website or server data off our systems before the service ends, that data will be deleted and we will not be able to provide a backup copy of it.

7.4 For trial or free services: as soon as the service ends, all such products and any accompanying services and data are deleted or reclaimed.

Article 8: Rules on adding to and amending customer details while using the service

8.1 Changes to customer information are made within a maximum of 03 business days from the time Pho Tue SoftWare Solutions JSC receives a valid amendment request with the required documentation. Pho Tue SoftWare Solutions JSC cannot and will not be liable, nor pay compensation, for any consequence or loss arising from your failure to comply with this requirement.

8.2 The details that can be amended or corrected are:

8.2.1 The registrant or the registrant's details (contact address, phone, name, and so on) are misspelled or incomplete.

8.2.2 Service specifications do not match the description on hitechcloud.vn.

8.2.3 The domain name registered is incomplete or incorrect.

8.2.4 Another service term is incorrect.

8.2.5 You have paid and provided complete registration details but have not received confirmation that the service was successfully ordered.

8.2.6 The registrant's name in the following cases:

− An organization changes its name by decision of a competent authority;

− Change of the domain registrant due to a merger, consolidation or change in the functions and duties of an agency or organization under a decision of the competent state authority;

− Reorganization of the enterprise under the Law on Enterprises (Luật Doanh nghiệp), or a sale of the business, capital contribution or share transfer between enterprises, or a transfer of functions and duties between a parent company and its subsidiaries, resulting in a change of the domain name registrant;

− An individual changes their name by decision of a competent state authority.

8.3 You must declare completely accurate registration information. The same information — such as the subject's name, address, phone number, email, tax code, or ID number — should not be used to create more than one transaction account with Pho Tue SoftWare Solutions JSC. This makes it easier for you to manage your services with Pho Tue SoftWare Solutions JSC in one place.

8.4 Requests to change related details may incur a charge.

Article 9: Customer support

9.1 Pho Tue SoftWare Solutions JSC bears no responsibility for responding to inquiries or complaints from third parties relating to your use of the service. Pho Tue SoftWare Solutions JSC is likewise not responsible for responding to inquiries or complaints about issues relating to any third-party service you use.

9.2 Pho Tue SoftWare Solutions JSC provides technical support to your designated administrator in accordance with the support principles applicable to the Service.

9.3 Before submitting a technical support request, you are responsible for backing up your own data, attempting to fix the problem yourself, and checking technical issues, functionality and network connectivity. Pho Tue SoftWare Solutions JSC accepts technical support requests through two channels only: the hotline on 0865920041 and the websites client.hitechcloud.io.vn and my.photuesoftware.vn

9.4 We use a PIN so that our customers can verify their own account details when contacting the call center0865920041 to request technical support. Each customer is issued a 4-digit PIN. The PIN is generated for you and you can change it yourself at client.hitechcloud.io.vn or my.photuesoftware.vn.

You understand and agree that when you call the technical support line 0865920041 and correctly provide your PIN together with one other piece of information (may be an email address, customer ID, phone number, service domain name and so on), we treat that as sufficient to confirm that you are indeed our service customer for support purposes. You should therefore keep your PIN safe and change it regularly for security.

Article 10: Limitation of liability and disclaimer of warranties

10.1 In all cases, Pho Tue SoftWare Solutions JSC is not responsible for the equipment you use to access our website, whether access devices or transmission equipment. To use the service you must provide the machines and equipment needed to log in and transmit data, and you bear all responsibility and all costs arising from that use.

10.2 Pho Tue SoftWare Solutions JSC does not guarantee the elimination of factors that may harm your use of the Service, including but not limited to: intentional harmful acts by third parties, or viruses. We do not guarantee that the Service will be provided free of any malfunction, error, or other disruption.

10.3 Pho Tue SoftWare Solutions JSC does not undertake to recover data infected by a virus, or to remove viruses and other harmful elements, when a problem occurs. Customers must agree to back up all data stored on Pho Tue SoftWare Solutions JSC servers regularly, and particularly before requesting technical support from us. Pho Tue SoftWare Solutions JSC accepts no responsibility for data loss or for any damage relating to customer data.

10.4 Pho Tue SoftWare Solutions JSC does not guarantee and accepts no responsibility for any data loss occurring while Support is provided to a customer migrating data from another server or another location to a Pho Tue SoftWare Solutions JSC server.

10.5 Pho Tue SoftWare Solutions JSC will not install SSL at your request in the following cases:

10.5.1 Your SSL certificate is not a service registered with Pho Tue SoftWare Solutions JSC.

10.5.2 Your SSL certificate is registered with Pho Tue SoftWare Solutions JSC, but you request technical support to install it on a system not hosted by Pho Tue SoftWare Solutions JSC (Cloud Hosting, Cloud Server, Email).

10.5.3 Installing SSL inside a Cloud Server that is not covered by one of our premium support plans.

10.6 Factors beyond our control may cause a product fault. We will try to fix product faults to your satisfaction, but we are not liable to support or compensate you for such risks or for any resulting loss.

10.7 You agree to defend, indemnify, and hold us harmless from legal obligations, proceedings, losses, and costs, including but not limited to court fees and the fees of lawyers and expert advisers, relating to the resolution of, or arising from, your breach in the course of using our products.

10.8 You understand and agree that We will not be liable for any damages or consequential losses (including but not limited to loss of profit, loss of goodwill, loss of use of data or other intangible losses, even where We have advised you of the possibility of such losses) arising from: (i) the services, materials and products of Pho Tue SoftWare Solutions JSC; (ii) the availability or unavailability of the service; (iii) unauthorized access to or alteration of data or information you transmit; (iv) the acts of any third party on the service; (v) products or messages sent or received using the service; or (vi) any other matter relating to the service, the materials or the products.

10.9 Under ICANN policy, you agree to accept the procedures for suspending, canceling, or transferring a domain name in the following cases: (1) resolution of a dispute relating to the domain registration, or (2) correction or supplementation of information due to an oversight by Pho Tue SoftWare Solutions JSC or the Registry during the domain registration process.

10.10 When you require technical support for services you use at Pho Tue SoftWare Solutions JSC, in some cases the Pho Tue SoftWare Solutions JSC technical support team will need to connect to your personal computer using third-party software such as UltraViewer or AnyDesk.

We disclaim all liability for data on your computer or personal devices during technical support sessions. Before we connect to your computer or device, you must therefore do the following: – Save any files, applications, or software you currently have open.
– Hide all files, applications, software, … that are unrelated to the service you use at Pho Tue SoftWare Solutions JSC and that we will assist you with.

Article 12: Free services

Within the limits permitted by law and its business direction, Pho Tue SoftWare Solutions JSC may provide one or more services free of charge to users. The scope of any free service is at the discretion of Pho Tue SoftWare Solutions JSC.

All intellectual property rights in the products and services of Pho Tue SoftWare Solutions JSC belong to Pho Tue SoftWare Solutions JSC or are lawfully licensed to us, and all lawful rights are reserved. Except with the consent of Pho Tue SoftWare Solutions JSC, you may not upload, send, publish, reproduce, transmit or distribute in any form any part of the products or services of Pho Tue SoftWare Solutions JSC.

Where files, images, software or programs created by Pho Tue SoftWare Solutions JSC are made available for download, we permit you to use them on a limited, non-commercial basis. That permission does not mean Pho Tue SoftWare Solutions JSC has granted you any right to exploit the copyright. You may not download the files in order to reproduce, publish, announce, transfer or distribute them. You must also follow any other instructions we set when you wish to use these files.

Users are solely responsible for any information they obtain when visiting the website. We make no warranty as to the source, accuracy, or completeness of that content.

You may stop using our services at any time. Pho Tue Software Solutions JSC will continue to change and improve its services. We will give you reasonable advance notice when we change or improve service functionality.

Article 13: Refund policy

For the types of service listed below, Pho Tue SoftWare Solutions JSC undertakes to issue a refund within 30 (thirty) days from the time service registration is completed.

The refund amount is calculated as follows:

Refund = total amount paid - [time used ≤ 30 days + other service fees + tax handling fees + bank transfer fees]

– Time already used:

Time used: 7 days or less; this fee is not charged.
Time used between 7 and 30 days: you pay only for the days actually used.
Time used: more than 30 days; this refund policy no longer applies, and the service moves to the refund policy under the terms and conditions of SLA

– Other service fees: a domain or premium SSL included as a promotion (if the service has already been activated).
- Tax handling fee: costs relating to an invoice already issued (if any).
– Transfer fee: the return transfer fee charged by the bank

For example, the Workspace service:On June 1, 2024 a customer subscribes to Workspace, 1 Plus license for 12 months: 40,900 VND x 12 months plus 10% VAT = 539,880 VND (VAT included).

Case 1: on 7 June 2024 (within 07 days of registration), the customer requests cancellation and a refund, and the service has already been invoiced. The customer submits a cancellation request together with any invoice-related costs, after which Pho Tue SoftWare Solutions JSC refunds 85% of the total amount paid: 539,880 VND × 85% = 458,898 VND (including VAT), before any bank transfer fees and other related costs.
Case 2: On 30/06/2024 (within 30 days of registration) the customer requests cancellation and a refund, and the service has already been invoiced => the customer prepares a service liquidation record plus any related invoice costs, after which Pho Tue SoftWare Solutions JSC refunds the 11 unused months: (VND 40,900 x 11 months) x 10% VAT = VND 494,890 (excluding bank transfer fees).
Case 3: An individual customer requests a refund on 30/06/2024 (within 30 days of registration) and the service has already been invoiced => the customer prepares a service liquidation record plus any related invoice costs, after which Pho Tue SoftWare Solutions JSC refunds the unused days before VAT: VND 40,900 x 11 months = VND 449,900 (excluding bank transfer fees).

For example, hosting services:On 1 October 2020, the Customer registered the WordPress Hosting v3 Store plan for a 12-month term: VND 199,000 x 12 months x 10% VAT = VND 2,626,800 (VAT included). The Customer also registered a .com domain bundled with the plan, valued at VND 299,000 x 10% VAT = VND 328,900 (VAT included), with free Let's Encrypt SSL installation.

Case 1: on 7 October 2020 (within 07 days of registration), the customer requests cancellation and a refund. The customer submits a cancellation request together with any invoice-related costs, after which Pho Tue SoftWare Solutions JSC refunds the full amount paid (including 10% VAT), less the .com domain registration fee: 2,636,800 VND − 328,900 VND = 2,307,900 VND (before bank transfer fees; the service has not been invoiced).
Case 2: on 30 October 2020 (within 30 days of registration), the customer requests cancellation and a refund, and the service has already been invoiced. The customer prepares a service cancellation record together with any invoice-related costs, after which Pho Tue SoftWare Solutions JSC refunds the 11 unused months less the .com domain cost: ((199,000 VND × 11 months) − 299,000 VND) × 10% VAT = 2,079,000 VND (before bank transfer fees).
Case 3: an individual customer requests a refund on 30 October 2020 (within 30 days of registration) and the service has already been invoiced. The customer prepares a service cancellation record together with any invoice-related costs, after which Pho Tue SoftWare Solutions JSC refunds the unused days before 10% VAT, less the .com domain cost: (199,000 VND × 11 months) − 299,000 VND = 1,890,000 VND (before bank transfer fees).

Article 14: Service time reservation policy

While using a service with Pho Tue SoftWare Solutions JSC, you can place the service term on hold to save money and avoid wasting resources during a period when you do not need to continue using it.

Example: you have just signed up for 12 months of hosting with Pho Tue SoftWare Solutions JSC, but after only one month your website design project is unfinished and has to be put on hold. Rather than let the hosting term run down, you should use this hold feature to preserve the 11 unused months. When using this feature you must comply with the following policies:

14.1 The service term suspension policy applies only to the MAIN service types listed below, such as:Email Pro, Email 4B, Cloud Hosting, Premium Cloud Hosting, WordPress Hosting.

14.2 Pho Tue SoftWare Solutions JSC only preserves the expiry date of the service. You are responsible for backing up all data relating to the service yourself. Pho Tue SoftWare Solutions JSC accepts no responsibility for the integrity of your data.

14.3 While the Service is held in suspended/reserved status, you will not be able to use it or perform any operation related to the suspended Service. Also during this period, you may not request that Pho Tue SoftWare Solutions JSC reactivate the Service ahead of schedule. The Service will automatically resume according to the time frame you selected.

14.4 The hold policy applies where a service has more than 2 months remaining before expiry. Each service may be placed on hold only once for the whole time it is used with Pho Tue SoftWare Solutions JSC.

14.5 The service-term hold feature is one you choose and enable yourself, directly at client.hitechcloud.io.vn or my.photuesoftware.vn. It is currently available to retail customers only.

Final provisions: terms of service

The rules and policies set out in these terms are designed to protect the rights of users acting in good faith, and to support service quality and long-term stability. They are also intended to prevent abuse and unlawful behavior.
