Affiliate Program Policy
PART I. PURPOSE AND SCOPE OF APPLICATION
Article 1. Purpose
1.1. This Policy governs HiTechCloud's Affiliate Program, which allows Affiliates to refer customers to HiTechCloud's products and services through an Affiliate Link or other valid tracking methods.
1.2. When a customer completes a valid transaction under the program rules, the Affiliate earns commission in accordance with this Policy.
1.3. This policy forms an integral part of HiTechCloud's Terms of Service and related policies.
Article 2. Who can participate
The program applies to:
a) Individuals aged 18 years old or older, with full civil capacity as defined by law;
b) Enterprises and organizations with valid business registration;
c) KOLs, KOCs, bloggers, influencers, marketing agencies or other media partners;
d) Individuals working in information technology or related fields, provided that taking part in the program does not breach the rules of their current employer.
Legal basis
This policy is based on:
- Civil Code 2015;
- Law on Tax Administration 2019;
- Law on Advertising 2012;
- Law on Protection of Consumer Rights 2023;
- Decree 91/2020/NĐ-CP on combating spam email, spam messages and spam calls;
- Relevant legal provisions.
PART II. COMMISSION MECHANISM
Article 3. Commission policy
Commission is calculated on valid orders and paid at the following rates:

HiTechCloud may adjust commission rates by promotion or by period, and will give advance notice on the Affiliate Portal.
Bonus based on monthly revenue

Article 4. Cookies and tracking
4.1. HiTechCloud uses cookies or equivalent technologies for tracking, for a period of 60 days from the most recent valid click.
4.2. Commission is recorded on the following basis Last-Touch Attribution, unless otherwise specified in each program.
4.3. Cookies are used in accordance with HiTechCloud's current Cookie Policy.
PART III. AFFILIATE RIGHTS AND OBLIGATIONS
Article 5. Affiliate obligations
Affiliates are responsible for:
a) Promote products and services honestly and accurately, making no commitments beyond what HiTechCloud has published;
b) Comply with the law on advertising, e-commerce and consumer protection;
c) Do not engage in spam email, spam messaging, spam commenting or any other unauthorized form of promotion;
d) Not engaging in fraudulent practices such as cookie stuffing, click fraud, creating fake orders or any other form of fraud intended to generate commission;
e) Do not engage in brand keyword bidding, including but not limited to keywords containing “HiTechCloud” or “Pho Tue Software”, or HiTechCloud's domain names or trademarks, without prior written approval;
f) Do not make self-referral transactions or create orders for yourself in order to earn commission;
g) Commission is payable only on customers and transactions that are valid under HiTechCloud's rules.
Article 6. Payment and tax
6.1. Commission is paid by bank transfer on a monthly cycle.
6.2. The minimum payment per period is 500,000 VND or another level published by HiTechCloud from time to time.
6.3. Commission is paid only on completed transactions with no refund, service cancellation or dispute.
6.4. Tax declaration and withholding are carried out in accordance with Vietnamese law.
- For individuals: HiTechCloud withholds tax (where withholding applies) before making payment.
- For organizations: the organization is responsible for its own tax declaration and payment.
PART IV. VIOLATIONS AND TERMINATION
Article 7. Program suspension and termination
HiTechCloud may suspend or terminate an affiliate account in the following cases:
- Violating the Affiliate Policy;
- Fraudulent conduct or creation of invalid transactions;
- Breaking the law or damaging HiTechCloud's reputation;
- Providing false or falsified information.
Where fraud is detected, HiTechCloud may:
- Cancel invalid transactions;
- Refusing payment or clawing back commission;
- Lock the Affiliate account;
- Terminate participation in the program without compensation.
PART V. EFFECT
Article 8. Effective date
8.1. This policy takes effect from 19/05/2026.
8.2. HiTechCloud may amend, supplement or replace this Policy to reflect its business operations or legal requirements. The updated version will be published on the website or on the Affiliate Portal.
8.3. This policy is reviewed at least every Once every 12 months or whenever necessary.
